NIcish,pce, Nlossachaasetts 0;2649 <br /> k�rf <br /> Decision for a Variance <br /> RE: Michael Welch 277 Monomocoy Road <br /> Map 120 Block 39 <br /> V-06-32 <br /> A Petition was filed on March 28, 2006 for a Variance from Sections 174-31, <br /> 174-33 and 174-59 of the Zoning By-laws to seek relief from the setback requirements <br /> and distance to wetlands in order to build a new dwelling on property located in an R-3 <br /> zoning district at 277 Monomoscoy Road (Map 120 Block 39) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on April 7, 2006 and April <br /> 14, 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 26, 2006, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Frederick Borgeson, <br /> Marshall Brem, Jonathan Furbush and Eric Dublirer. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Kevin Kirrane of Dunning and Kirrane represents the petitioner a this <br /> hearing. They are seeking to demolish the existing dwelling and in order to rebuild a new <br /> dwelling need variance relief due to encroachment on the front yard. The lot is impacted <br /> by wetlands and streets on both sides. This home was initially created when the front set <br /> back was 25 or 30 feet. This will not impact other homes in the area in a negative <br /> fashion. There is an increase in setback from the wetlands and substantial plantings are <br /> proposed which have the added benefit of stabilizing the area helping impacts from <br /> storms and the like. The Board reviews the plans and the variance requests. The lot <br /> coverage will be at 18.8%. The Board moves to grant the following variances: <br /> ✓ A 22,161 square foot landspace variance <br /> ✓ An 8.5 foot frontyard setback <br />
