Cimeno, Jr. 29 Frog Pond Close <br /> Map 90 Parcel 92 <br /> V-06-40 <br /> A Petition was filed on May 1, 2006 for a Variance from Sections 174-31 and <br /> 174-33 of the Zoning By-laws to vary the setback requirements,the landspace <br /> requirements and distance to the wetlands on property located in an R-3 zoning district at <br /> 29 Frog Pond Close (Map 90 Parcel 92) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on May 12, 2006 and May 19, <br /> 2006 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was'held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 14, 2006 at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, Marshall <br /> Brem, Jonathan Furbush and James Reiffarth. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinksy of Cape &Islands Engineering,represents the applicants at this <br /> hearing. They are seeking a variance to vary the setback requirements,the landspace <br /> requirements and distance to the wetlands.. Mr. Slavinsky informs the Board that the <br /> Conservation Commission has reviewed the plan and has recommended they move the <br /> house up and rebuild the masonry retaining wall and consider this the new work limit. <br /> The Board of Health has approved the plan at a maximum of four bedrooms. A neNv <br /> septic system will be an impr6vement to the area as well as the proposed look of the new <br /> dwelling. There are soil problems as well as problems with the shape of the lot. The lot <br /> coverage with the proposed new dwelling will be 12.4%. The Board reviews the plans <br />
