Cimeno, Jr. 29 Frog Pond Close Margaret Cimeno Map 90 Parcel 92 SP-06-41, A Petition was filed on May 1, 2006 for a Special Permit under Section 174-20 of the Zoning By-laws for permission to demolish and rebuild a new 4 bedroom dwelling on property located in an R-3 zoning district at 29 Frog Pond Close (Map 90 Block 92) Maslipee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on May 12, 2006 and May 19, 2006, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, June 14, 2006, at which time the following members of the Zoning Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, Jonathan Furbush, James Reiffarth and Marshall Brem. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of Mashpee Zoning By-laws. John Slavinksy of Cape & Islands Engineering, represents the applicants at this hearing. They are seeking a special permit to demolish the existing dwelling and rebuild a new 4 bedroom dwelling. Mr. Slavinsky informs the Board that the Conservation Commission has reviewed the plan and has recommended they move the house up and rebuild the masonry retaining wall and consider this the new work limit. The Board of Health has approved the plan at a maximum of four bedrooms. A new septic system will be an improvement to the area as well as the proposed look of the new dwelling. The t Board reviews the plans and makes a motion to grant the special permit.
