Cimeno, Jr. 29 Frog Pond Close <br /> Margaret Cimeno Map 90 Parcel 92 <br /> SP-06-41, <br /> A Petition was filed on May 1, 2006 for a Special Permit under Section 174-20 of <br /> the Zoning By-laws for permission to demolish and rebuild a new 4 bedroom <br /> dwelling on property located in an R-3 zoning district at 29 Frog Pond Close (Map 90 <br /> Block 92) Maslipee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on May 12, 2006 and May <br /> 19, 2006, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 14, 2006, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Jonathan Furbush, James Reiffarth and Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinksy of Cape & Islands Engineering, represents the applicants at this <br /> hearing. They are seeking a special permit to demolish the existing dwelling and rebuild <br /> a new 4 bedroom dwelling. Mr. Slavinsky informs the Board that the Conservation <br /> Commission has reviewed the plan and has recommended they move the house up and <br /> rebuild the masonry retaining wall and consider this the new work limit. The Board of <br /> Health has approved the plan at a maximum of four bedrooms. A new septic system will <br /> be an improvement to the area as well as the proposed look of the new dwelling. The <br /> t Board reviews the plans and makes a motion to grant the special permit. <br />
