Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation in the Town of Mashpee, on May 12, 2006 and May
19, 2006, a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, June 14, 2006, at which time the following members of the Zoning Board
of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, Eric
Dublirer, Jonathan Furbush and Marshall Brem.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of
Mashpee Zoning By-laws.
John Proccasino represents himself at this hearing. He is seeking a special permit
to demolish and rebuild the existing dwelling. The narrow lot proposes a limited space
use and the detached garage up towards the front of Monomoscoy Road seems to be the
best spot for the garage with the new septic system. The Conservation Commission has
approved the plans. The new dwelling will not be more detrimental the area and a new
title v system will be a big improvement for the neighborhood. Marshall Brem moves to
grant the special permit.
