Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation in the Town of Mashpee on May 12, 2006 and May
19, 2006, a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, June 14, 2006, at which time the following members of the Zoning Board
of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry,
Marshall Brem, Jonathan Furbish and Eric Dublirer.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of
Mashpee Zoning By-laws.
John Procaccino represents himself at this hearing. They are seeking a variance
request to the Board on this property in order to rebuild the new dwelling. They need
sideyard setback relief, landspace relief since the demolition of the house will render the
lot too small for the R-3 district and frontage relief. After reviewing the plans and
considering the narrow shape of the lot the board discusses the positive outcolne,of a new
dwelling on that lot and the fact that there are several similar situations that they have
granted this type of relief for. There will be storage above the garage and the lot
coverage will be less than 20%. The Board would like only the certified plot plan to be
considered in this decision not the architectural plans. Marshall Brem moves to grant the
following variances:
