This property is located in an R-5 zoning district at 103 Meetinghouse Road <br /> (Map 45 Parcel 50) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on May 12, 2006 and May 19, <br /> 2006 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, June 14, 2006 at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, Marshall <br /> Brem, Jonathan Furbush and James Reiffarth. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinsky of Cape & Islands Engineering represents the petitioners. <br /> Originally, the applicants donated 17 acres of land to the Town of Mashpee. There was a <br /> parcel left of 6.8 acres which he is looking to subdivide for his family at this point. There <br /> is sufficient frontage and this R-5 zoning calls for 80,000 square feet for each parcel. Mr. <br /> Lopez would like to create 2 additional lots for his children each containing 80,000 <br /> square feet. This leaves the parcel that his home is presently situated on just shy of the <br /> required 80,000 square feet. He is seeking a 2,800 square foot landspace variance to <br /> deem this lot buildable in order to complete the subdividing. The Board discusses any <br /> concerns the fire department may have as well as the road that will need to be built for <br />
