Mashpee Zoning David and Donna Paparella <br /> Board of Appeals <br /> 2 V-05-24 <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 67 Popponesset Island Road and <br /> contains 11,270 square feet. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br /> not the district in which it is located and that a literal enforcement of the By-laws would <br /> involve hardship to the petitioner. <br /> SPECIFIC FINDINGS <br /> h. that a literal enforcement of the By-laws would involve hardship to the <br /> Petitioner. <br /> 2. that relief may be granted without detriment to the public good. <br /> 3. that relief may be granted without derogating from the intent or purpose of the <br /> By-laws. <br /> In view of the foregoing,the Mashpee Zoning Board of Appeals found that the <br /> applicant met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on February 23, <br /> 2005 to grant the following Variances: <br /> ✓ A 2.8 foot variance from the westerly side <br /> ✓ A 4-1 foot variance from the easterly side <br /> ✓ A 25.2 foot variance from Popponesset Island Road <br /> These variances are conditioned on compliance with the proposed site plans from J.E. <br /> Landers-Cauley, of West Falmouth, MA, dated January 12, 2005, revised January 18, <br /> 2005 and revised February 10, 2005, Job. No. 407-05. <br />
