Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on January 28, 2005 and <br /> February 4, 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, February 9, 2005 at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert G. Nelson, Richard Guerrera, <br /> Zella Elizenberry, Frederick Borgeson, Evano Cunha and Jonathan Furbush. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinsky of Cape & Islands Engineering represents the Petitioner. She is <br /> seeking a variance to the cranberry bogs in order to build a new house on the vacant lot. <br /> The current zoning is 150' from any cranberry bog that has been in existence for the past <br /> 5 years—she is seeking a 93' variance to build on lot 44 that contains over 46,000 square <br /> feet. There are several people in the audience who are vehemently opposed to building <br /> so close to the bog. The abutters that spoke in opposition to these variances are: Vicki <br /> Holmes, Dan Cronin, Jerry Thibideault. They are all of the opinion that they want to <br /> preserve the bog view, they don't want the house in the middle of the bog and they don't <br /> want a driveway/street that will be paved and used unnecessarily.
