Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, February 18, 2005 and <br /> February 25, 2005 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition on March 9, 2005 and continued until <br /> March 23, 2005 at the Mashpee Town Hall at which time the following members of the <br /> Zoning Board of Appeals were present and acting throughout: Robert Nelson, Zella <br /> Elizenberry, Richard Guerrera, Frederick Borgeson and Jonathan Furbush. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Kevin Kirrane represents the applicant at this hearing. Also present is <br /> architect, Peter Polhemus of Polhemus, Savery and DaSilva . They are requesting a <br /> special permit in order to raze and reconstruct a pre-existing non conforming structure. <br /> Attorney Kirrane presents his argument to the board and they review pictures of similar <br /> dwellings in the neighbor that currently exist now to show that this proposed structure is <br /> not more detrimential to the area. The current structure is 23.11 feet from Deans Hollow <br /> —the Popponesset Overlay District dictates that the dwelling must be 25 feet from the <br /> `t <br /> street. The new house will comply with that by-la«v. The current side setbacks are 4.2 <br />
