Notice was given by publication in The Mashpee Enterprise,
a newspaper of general circulation in the Town of Mashpee, February 18, 2005 and
February 25, 2005 a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition on March 9, 2005 and continued until
March 23, 2005 at the Mashpee Town Hall at which time the following members of the
Zoning Board of Appeals were present and acting throughout: Robert Nelson, Zella
Elizenberry, Richard Guerrera, Frederick Borgeson and Jonathan Furbush.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of
Mashpee Zoning By-laws.
Attorney Kevin Kirrane represents the applicant at this hearing. Also present is
architect, Peter Polhemus of Polhemus, Savery and DaSilva . They are requesting a
special permit in order to raze and reconstruct a pre-existing non conforming structure.
Attorney Kirrane presents his argument to the board and they review pictures of similar
dwellings in the neighbor that currently exist now to show that this proposed structure is
not more detrimential to the area. The current structure is 23.11 feet from Deans Hollow
—the Popponesset Overlay District dictates that the dwelling must be 25 feet from the
`t
street. The new house will comply with that by-la«v. The current side setbacks are 4.2
