Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on March 25, 2005 and April <br /> 1, 2005 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 25, 2005, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, Evano <br /> Cunha, Jonathan Furbush and Eric Dublirer. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Sanicki of Cape &Islands Engineering represents the applicant at this <br /> hearing. They are seeking to raze and replace the current dwelling on this property. <br /> They have also requested relief from the wetlands by law and the fire department bylaw <br /> that requires the farthest point of the structure be no more than 150 feet from the <br /> pavement in the street for access by the fire trucks. The Board reviews the plans and asks <br /> about moving the house in a different direction. Mr. Sanicki informs them that moving it <br /> any other way would put the property in the flood zone which would require different <br /> construction and materials. The applicant is not seeking to push the house any further <br /> away from the fire access area than what currently exists now. The Board has no <br />
