OWN <br /> wdlown of Mashpce <br /> 4✓� <br /> ( tQl 16 Great Xeck koa(l NY )oh <br /> Nlashpce Nlassacl2usetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Punkhorn Point Realty LLC 80 Punkhorn Point Road <br /> Map 100 Parcel 4 <br /> V-05-46 <br /> A Petition was filed on March 18, 2005 for a Variance from Sections 174-31, <br /> 174-32 and 174-33 of the Zoning By-laws to seek relief from the lot frontage <br /> requirements, setback to the wetlands and from the fire protection by law requiring the <br /> said access roadway shall be constructed to a point no less than 150 feet from the furthest <br /> point of any building on the lot on property in order to build a new dwelling on property <br /> located in an R-3 zoning district at 80 Punkhorn Point Road(Map 100 Parcel 4) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation on March 25, 2005 and April 1, 2005, a copy of which <br /> is attached hereto and made a part in the Town of Mashpee, on hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, May 25, 2005, at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, Evano <br /> Cunha, Jonathan Furbush and Eric Dublirer. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Sanicki of Cape &Islands Engineering represents the applicant at this hearing. <br /> They are seeking to raze and replace the current dwelling on this property. They have <br /> also requested relief from the wetlands by law and the fire department bylaw that requires <br /> the farthest point of the structure be no more than 150 feet from the pavement in the <br /> I <br /> street for access by the fire trucks. The Board reviews the plans and asks about moving <br />
