M <br />Mashpee Select Board <br />Minutes <br />January 10, 2022 <br />LIAISON REPORTS <br />Assembly of Delegates: The Assembly is working proactively on securing ARPA funding for the 15 <br />Cape towns. The disbursement of federal funds was earmarked however, the allocation of monies has <br />been unexpectedly altered. <br />TOWN MANAGER UPDATES <br />COVID Update: Over the past weekend 83 new cases have been reported. <br />Retirements: The Town of Mashpee will be losing two longtime Department Heads within the next <br />few months. <br />ARPA Funding: The Town Administrators on Cape Cod are also seeking answers to the shift in <br />the disbursement of American Rescue Plan Act funds anticipated for clean water and wastewater <br />objectives. <br />EXECUTIVE SESSION <br />Discuss Strategy with Respect to Pending Litigation in the Matter of Scannell, et al. v. Mashpee <br />Zoning Board of Appeals and Town of Mashpee, with the Chair Having Declared that an Open <br />Meeting mqy Have a Detrimental Effect on the Litigating Position of the Town Pursuant to G.L. c. <br />30A, §21 (a)(3): <br />Motion made by Selectman Gottlieb to move that the Board convene in executive session at 6:42 <br />p.m. pursuant to G.L. c. 30A, §21(a)(3) to discuss strategy with respect to pending litigation in <br />the matter of Scannell, et al. v. Mashpee Zoning Board of Appeals and Town of Mashpee, with <br />the Chair having declared that an open meeting may have a detrimental effect on the litigating <br />position of the Town. <br />The Board of Selectmen will not reconvene in Open Session. <br />Chair Sherman so declared that an open meeting on these issues may have a detrimental effect <br />on the litigating position of the Town. <br />Motion seconded by Selectman Sherman. <br />VOTE: Unanimous. 5-0. <br />Roll Call Vote: <br />Selectman Sherman, yes Selectman Weeden, yes Selectman Gottlieb, yes <br />Selectman Cotton, yes Selectman O'Hara, yes Opposed, none <br />Respectfully submitted, <br />Kathleen M.
