GA, Town of Mashpee 16 0-cat Meck Pvo(id -Vooh MASHPEE ZONING BOARD OF APPEAL§I(Ishpce, NI(issachUSCUS 02649 Decision for a Variance RE: Eric Shaw 6 Kristina Lane Map 78 Parcel 104 V-05-57 A Petition was filed on April 5, 2005 for a Variance from Section 174-31 of the Zoning By-laws to vary the current setback requirements in order to build a 24' x 24' garage on property located in an R-5 zoning district at 6 Kirstina Lane (Map 78 Block 104) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation on April 8, 2005 and April 15, 2005, a copy of which is attached hereto and made a part in the Town of Mashpee, on hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, April 27, 2005, at which time the following members of the Zoning Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, Frederick Borgeson, Marshall Brem and Jonathan Furbush. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of Mashpee Zoning By-laws. Eric Shaw represents himself at this hearing.. He is seeking a sideyard variance in order to build a 24' x 24' garage. Mr. Shaw mentions that there is a utility easement to the south and therefore, he cannot utilize that area of the property for the garage. The plans are reviewed by the board and they feel this is a reasonable request. The Board of Health has commented that there needs to be a septic inspection done. Mr. Shaw agrees to get this done. The Board moves to grant the variance. GENERAL FINDINGS 1. that the subject property is located at 6 Kristina Lane and contains 56,222 square feet.
