lown of Mashpce <br /> MASHPEE ZONING BOARD OF APPEALS 16 Grcat,,Vcck PvoadM)rth, <br /> Mashpce, Massachusetts 02649 <br /> DECISION FOR A VARIANCE <br /> Re: Lawrence Herman 43 Uncantena Road <br /> Map 123 Parcel 61 <br /> V—05-52 <br /> A Petition was filed on March 31, 2005 for a Variance under Sections 174-31 and <br /> 174-33 of the Zoning By-laws for permission to vary the required setback requirement <br /> and to seek relief from the required distance to the wetlands in order to construct an new <br /> entryway, a mudroom and open farmer's porch on property located in an R-3 zoning <br /> district at 43 Uncantena Road (Map 123 Parcel 61) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on April 8, 2005 and April 15, <br /> 2005, a copy of which is attached hereto and made a pall hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 27, 2005 at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, Frederick <br /> Borgeson, Evano Cunha and Jonathan Furbush. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Anthony Ferragamo, Architect, represents the applicants at this hearing. They are <br /> seeking a special permit to alter a pre-existing non-conforming structure and a variance <br /> from the setback requirements and wetland requirements. They are proposing to remove <br /> the existing bulkhead and make a new entryway and mudroom in addition to adding a <br /> roof to the porch and add an open farmer's porch. The total coverage will be at 19.6%. <br /> The Board reviews the plans and setback requests. The Conservation Commission has <br /> approved the proposed plans. Mr. Ferragamo also mentions they are not changing the <br />
