Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on August 26, 2005 and <br /> September 2, 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 14, 2005, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Marshall Brem, Frederick Borgeson and Evano Cunha. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Eric Lubrano represents the applicants at this hearing. They are seeking a <br /> variance for sideline setback relief and distance to the wetlands relief. The Board <br /> reviews the plans of the expansion and they discuss the site visit several of the board <br /> members made. Marshall Brem feels this will enhance the property and will not make <br /> the dwelling any more detrimental to the area. Mr. Cunha feels strongly against the <br /> granting of the wetlands variance. He feels this land should be preserved at all costs. <br /> Marshall Brem moves to grant a 38 foot variance to the wetlands and a 9.9 foot sideyard <br /> variance. Robert Nelsons seconds the motion. Zella Elizenberry votes in favor. Evano <br /> Cunha votes against the variance. Frederick Borgeson votes in favor. The variance is <br /> carried 4-1. <br />
