This property is <br /> located in an R-3 zoning district at 15 Herring Gull Road (Map 76 Parcel 125) Mashpee, <br /> MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 26, 2005 and <br /> September 2, 2005 a copy of which is attached hereto and made a part hereof. <br /> A Public hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 14, 2005 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Frederick Borgeson, Jonathan Furbush and Evano Cunha. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the ToNvil of <br /> Mashpee Zoning By-lawns. <br /> Attorney Jack McElhinney represented Willowbend Country Chub for this <br /> variance request. This matter was before the Board in September however the was a <br /> matter with a direct abutter Mr. Jack Hart that needed to be addressed. The Board asked <br /> Attorney McElhinney to take care of his concerns before the Board would further <br /> entertain testimony regarding this variance request. The matter has been taken care of <br /> per Attorney McElhinney and they are here to night to ask for the variance in lot size in <br /> order to deem the lot buildable as the Board granted previously on 69 Shoestring Bay <br /> Road. The total lot area was 32,181 reduced by 10,087 square foot golf course easement, <br />
