This property is <br /> located in an R-3 zoning district at 69 Shoestring Bay Road (Map 77 Parcel 137) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 26, 2005 and <br /> September 2, 2005 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 14, 2005 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Marshall Brem, Frederick Borgeson and Evano Cunha. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Jack McElhinney represents the applicant at this hearing. In 1998, 38 <br /> lots were acquired by Willowbend that were checker boarded to be built in 1999. There <br /> were 37 variances recorded. The Cape Cod Commission required Willowbend to <br /> preserve a portion of the land due to the golf modification. This particular lot is in need of <br /> a variance for the lot size in order to build a single-family dwelling. As part of the recent <br /> addition of a new nine-hole golf course at Willowbend, 69 Shoestring Bay has been <br /> reconfigured. Portions of the old configuration were converted to golf use and <br /> 4 <br /> Willowbend, as owner of the lot would like to add 69 Shoestring Bay to the existing <br />
