Hajjar, Trustee Map 81 Block 36 <br /> SP-05-127 <br /> A Petition was filed on November 17, 2005 by Eastern Bank for Special Permit <br /> for permission to revise the site plan, landscaping and parking plans on property located <br /> in a C-I zoning district at Route 28 and Shellback Place (Map 81 Block 36) Masllpee, <br /> MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on November 25, 2005 and <br /> December 2, 2005, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was-held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 14, 2005, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Frederick Borgeson, Evano Cunha and Jonathan Furbush. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Kevin Kirrane of Dunning& Kirrane represented the applicants,at this <br /> hearing. They were originally before the Board with Plymouth Savings Bank was the <br /> owner. Eastern Bank has now taken it over and their plans for the building have changed. <br /> They will be revising the existing site plan and reconfiguring the site parking and traffic <br /> circulation. The are proposing to eliminate an access and egress from Shellback Place <br /> The parking lot will be changed and they have worked extensively with the Fire <br /> Department and the owners to get this accomplished. The Fire Department is requiring <br /> the number of the building must be visable from the nearest public way. The applicant is <br /> seeking a special permit from the ZBA in order to the Bank to operate at that location. <br /> They are proposing an exit onto Shellback Way and one way in and one way out into <br /> Deer Crossing. Mr. Nelson has mentioned to Attorney Kirrane that he would like <br /> something produced in writing to show that the Bank has rights/lease to access Deer <br /> Crossing in the future for the building—thus showing specific authorization to access Deer <br /> Crossing. Attorney Kirrane has been working on that and will produce that as soon as the <br /> agreement is drawn up. BSS Design has done Lip a landscaping plan that Design Review <br /> has approved. Mr. Nelson discusses adding a section of the by law that pertains to the <br /> parking in front of the building. Attorney Kirrane feels this does not apply since they are <br /> really within the prevue of the original special permit although it has been noted that Mr. <br />
