:r •a:ys Town of Mashpee 16 Great Xeck load Jlorth L MASHPEE ZONING BOARD OF APPEA t lash1ee lklassa.chusetts 02649 Decision for a Special Permit RE: Janet Procek 12 Great River Road Map 120 Parcel 63 SP-05-129 A Petition was filed on October 26, 2005 by Janet Procek for a Special Permit under Section 174-25.I.9 of the Zoning By-laws to allow for construction of a pier, ramp and float on property located in an R-3 zoning district at 12 Great River Road (Map 120 Parcel 63) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on November 25, 2005 and December 2, 2005, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, December 14, 2005 at which time the following members of the Zoning Board of Appeals were present and acting throughout: Zella E. Elizenberry, Robert Nelson, Evano Cunha, Jonathan Furbush and Frederick Borgeson. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of Mashpee Zoning By-laws. David Sanicki of Cape & Islands Engineering represents the applicant at this hearing. They are seeking a special permit for a pier, ramp and float. The pier will be 58 feet long and is well under the 70 foot allowable maximum. Conservation has approved the application. The Board reviews the plans and everything seems to be in order. Frederick Borgeson makes a motion to grant the special permit. Robert Nelson seconds the motion. A roll call vote is taken. Frederick Borgeson votes yes. Robert Nelson votes yes. Jonathan Furbush votes yes. Zella Elizenberry votes yes. Evano Cunha votes yes. Motion is carried.
