Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on November 25, 2005 and <br /> December 2, 2005 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 14, 2005 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Frederick Borgeson, Jonathan Furbush and Evano Cunha. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Geraldine Raposa represents herself at this hearing. She is seeking a variance in <br /> order to build an addition that she plans to use as an art studio. She needs a setback <br /> variance since she cant meet the 40 foot frontyard setback requirement. The houses in <br /> the immediate vicinity are all much closer to the street that she is proposing. The board <br /> reviews the plans and looks at the average setback between the houses on either side of <br /> her. The Board of Health requires there not be any additional bedrooms. Applicant is <br /> aware of this and plans to use the addition as a studio and will have a six foot opening. <br /> Evano Cunha moves to grant a 4.3 foot variance on the easterly side and a 24 foot <br /> frontyard setback variance. Robert Nelson seconds the motion. A roll call vote is taken. <br />
