Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on November 25, 2005 and <br /> December 2, 2005 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 14, 2005 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry, <br /> Frederick Borgeson, Jonathan Furbush and Evano Cunha. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Darlene Jolin-Pope represents herself at this hearing. She is seeking a variance <br /> from the setback requirements in order to build a garage. The Board reviews the plans <br /> and finds the request reasonable and all the paperwork in order. Evano Cunha makes a <br /> motion to grant a 15 foot variance on the southerly side. Motion is carried unanimously. . <br /> GENERAL FINDINGS <br /> 1. that the subject lot is located at 286 Meetinghouse Road and contains 40,929 <br /> square feet. <br /> VARIANCE CRITERIA <br /> Section 10 of Chapter 40A requires that the permit granting authority determine <br /> that there are circumstances relating to the shape and topography which affect this lot and <br />
