Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, March 5, 2004, and March 12, <br /> 2004 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, April 14, 2004 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James Regan, Robert Nelson and <br /> Zella Elizenberry. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Whittemore represents himself at this hearing. He is seeking to build an <br /> accessory apartment above his barn on his property. He has over 4 acres of land and there <br /> are 2 separate dwellings on this property. The Board feels that this is a reasonable <br /> request since Mr. Whittemore wife's just died and his daughter is going to move in to <br /> help him. The Board moves to grant this special permit. <br /> GENERAL FINDINGS <br /> 1. that the subject lot is located at 182 Main Street and contains 4.4 acres of land. <br /> SPECIAL PERMIT CRITERIA <br /> § 174-45.4 of the Zoning By-laws states: <br />
