rc lown of Mashpee
W` t
16 Great Jec oeacl<1ct t12.
Ib'las{apee, 1k7assac°la.usetts 02649
MASHPEE ZONING BOARD OF APPEALS
Decision for a Variance
RE: Steven and Leslie Garrigus 46 Snead Drive
Map 67 Parcel 67
V-04-68
A Petition was filed on April 14, 2004 by Steven and Leslie Garrigus for a
Variance from Section 174-31 of the Zoning By-laws for permission to vary the front
setback requirements to allow for construction of garage located in an R-5 zoning district
at 46 Snead Drive (Map 67 Parcel 67) Mashpee, MA.
Notice was duly given to abutters in accordance with Massachusetts General
Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a
newspaper of general circulation in the Town of Mashpee, on April 23, 2004 and April
30, 2004, a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, May 12, 2004 at which time the following members of the Zoning Board of
Appeals were present and acting throughout: James Regan, Robert Nelson and Richard
Guerrera.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of
Mashpee Zoning By-laws.
Architect Terry Luff represents petitioners at this hearing. They are seeking a
variance in order to build a garage. The placement of the house makes it difficult to
adhere to the current zoning and still expand the garage. The lot is also a corner lot and
this places additional burden on the petitioner to meet two frontage setbacks. The garage
doors will be facing Nelson Circle.
GENERAL FINDINGS
1. That the subject property is located at 46 Snead Drive and contains 15,102
square feet.
