16 Great r)Vcck goad r)V)rth
•. 'las{rpce> , Massachusetts 02649
MASHPEE ZONING BOARD OF APPEALS
Decision for a Variance
RE: Kevin and Michelle White 51 Tracey Lane
Map 99 Parcel 26
V-04-66
A Petition was filed on April 21, 2004 by Kevin White for a Variance from
Section 174-31 of the Zoning By-laws for permission to vary the front setback
requirements to allow for construction of a breezeway and garage located in an R-3
zoning district at 51 Tracey Lane (Map 99 Parcel 26)Mashpee, MA.
Notice was duly given to abutters in accordance with Massachusetts General
Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a
newspaper of general circulation in the Town of Mashpee, on April 23, 2004 and April
30, 2004, a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, May 12, 2004 at which time the following members of the Zoning Board of
Appeals were present and acting throughout: James Regan, Robert Nelson and Marshall
Brem.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of
Mashpee Zoning By-laws.
Kevin White represents himself at this hearing. He is seeking a variance in order
to build a garage and a breezeway. The house placement, again, makes it difficult for
applicant to build a garage and breezeway without needing a variance. He is presenting
eway and garage, which the Board reviews. An abutter,
proposal for a mudroom,breez
Daniel Kupfernal of 53 Tracey Lane, is in full support of the addition. The Board moves
to grant a 4.6 foot variance on Tracey Lane.
I,
k
