Mashpee Zoning
Board of Appeals Michael and Rebecca Robbins
2 V-04-86
GENERAL FINDINGS
1. That the subject property is located at 71 Main Street and contains 45,919
square feet.
SPECIFIC FINDINGS
1. the shape and topography of the subject property limit placement of the proposed
dwelling and septic system, therefore, a literal enforcement of the By-laws would
involve hardship to the Petitioner.
2. the proposed construction would be farther away from the wetlands than the existing
dwelling; therefore, relief may be granted without derogating from the intent or
purpose of the By-laws.
In view of the foregoing, the Mashpee Zoning Board of Appeals found that the
applicant met the criteria necessary for the granting of a Variance. Upon motion duly
made and seconded, the Zoning Board of Appeals voted unanimously on June 23, 2004 to
grant a 14.7- foot variance on the sideyard and a 12- foot variance in the front on Main
Street. Plans referenced are designed by John P. Doyle of Mashpee, MA, dated April 6,
2004 as prepared for Michael Robbins. Also submitted were floor plans of the existing
house along with the proposed dwelling for reference.
