Town of Mashpec N( S V _�•' 16 Gi-cat eck &ad JVort1� Mashpee, 'Iassach,USCUS 02649 MASHPEE ZONING BOARD OF APPEALS Decision for a Special Permit RE: Jilian Hayes 5 Compass Circle = Map 105 Parcel 260 SP-04-105 A Petition was filed on July 28, 2004 by Jilian Hayes for a Special Permit under Sections 174-17 and 174-20 of the Zoning By-laws for permission to demolish an existing dwelling and construct a single-family home on property located in an R-3 zoning district at 5 Compass Circle (Map 105 Block 260) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on August 6, 2004 and August 13, 2004, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, September 8, 2004, at which time the following members of the Zoning Board of Appeals were present and acting throughout: Zella Elizenberry, Richard Guerrera, James E. Regan III and Robert G. Nelson. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of Mashpee Zoning By-laws. Michael Grotkze of The Phoenix Group represents the applicant at this hearing. They are seeking a special permit to alter and demolish a pre-existing non-conforming structure and replace it with a new 5 bedroom dwelling. The board reviews the plans with Mr. Grotzke. This will be an improvement to the area with a new septic system as well. All is acceptable to the Board of Health and Conservation. The Board makes a motion to grant the Special Permit. GENERAL FINDINGS 1. that the subject property is located at 5 Compass Circle and contains 23,800 square feet. "G
