Lane <br /> 3 SP-04-136 <br /> 10. will not cause excessive erosion or cause increased runoff onto neighboring <br /> properties or into any natural river, stream, pond or water body and will not <br /> otherwise be detrimental to the town or the area. <br /> 11. the proposed structure will be farther away from the wetlands than the existing <br /> structure. <br /> 12. while the proposed structure will increase the non-conforming nature of the <br /> structure, the changes will not result in a structure or use which is more <br /> detrimental to the neighborhood than the prior non-conforming structure and <br /> its use. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the applicant <br /> met the criteria necessary for the granting of a Special Permit. Upon motion duly made <br /> and seconded, the Zoning Board of Appeals voted unanimously on October 13, 2004 to <br /> grant a Special Permit. The Special Permit is conditioned upon compliance with the site <br /> plans from Carmen Shay of East Falmouth, MA, dated September 17, 2004, File Name <br /> Lane, DWG, and plans from Terry Luff, Architect of Mashpee, MA, dated March 26, <br /> 2004. <br />
