Notice was given by publication in The Mashpee Enterprise, a
newspaper of general circulation in the Town of Mashpee, on September 24, 2004 and
October 1, 2004, a copy of which is attached hereto and made a part hereof.
A Public Hearing was held on the Petition at the Mashpee Town Hall on
Wednesday, October 13, 2004, at which time the following members of the Zoning Board
of Appeals were present and acting throughout: Robert Nelson, James Regan and Zella
Elizenberry and Frederick Borgeson.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of
Mashpee Zoning By-laws.
Paul Deptula from SavaTree represents himself at this hearing. He is seeking a
special use permit to allow the use of his tree care service business on Echo Road. It
would entail tree care functions, storage, and office space. This will be a service business
with 5 vehicles stored. The number of employees will range from a peak of 9 to
wintertime of perhaps 5 or so. He explains to the Board that his company is currently in
Cotuit and he would like to move it to Mashpee. The Board reviews the use law and
feels this is an appropriate request. The Board of Health has the following requests for
his business venture:
• A change of occupancy must have Board of Health approval
• Hazardous materials shall be limited to 200 pounds of dry weight and 220 gallons
of liquid storage
