Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on September 24, 2004 and <br /> October 1, 2004, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 13, 2004, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, James Regan and Zella <br /> Elizenberry and Frederick Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Paul Deptula from SavaTree represents himself at this hearing. He is seeking a <br /> special use permit to allow the use of his tree care service business on Echo Road. It <br /> would entail tree care functions, storage, and office space. This will be a service business <br /> with 5 vehicles stored. The number of employees will range from a peak of 9 to <br /> wintertime of perhaps 5 or so. He explains to the Board that his company is currently in <br /> Cotuit and he would like to move it to Mashpee. The Board reviews the use law and <br /> feels this is an appropriate request. The Board of Health has the following requests for <br /> his business venture: <br /> • A change of occupancy must have Board of Health approval <br /> • Hazardous materials shall be limited to 200 pounds of dry weight and 220 gallons <br /> of liquid storage <br />
