Mashpee Zoning
Board of Appeals Gary and Jane Gomes
2 V-04-140
variance on the side and a 14-foot variance in the rear. Mr. Borgeson would like to have
any future purchasers of lot#19 made aware of this situation before the lot is sold. Mr.
Bosse said that is not a problem.
GENERAL FINDINGS
1. that the subject property is located at 62 Regatta Drive and contains 15,015
square feet.
SPECIFIC FINDINGS
The Board determined that:
1. a literal enforcement of the By-laws would involve substantial hardship to
the petitioner.
2. Desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent or
purpose of the by-law.
In view of the foregoing, the Mashpee Zoning Board of Appeals found that the
Petitioner met the criteria necessary for the granting of an 8.6-foot variance on the side
and a 14-foot variance in the rear. Upon motion duly made and seconded, the Zoning
Board of Appeals voted unanimously on October 13, 2004 to grant this to Petitioner.
This variance is conditioned upon plans from Christopher Costa&Associates, Inc., dated
March 17, 2004 and revised June 18, 2004.
