Owner of record: Daisy Orent.
Notice was duly given to abutters in accordance with Massachusetts General
Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a
newspaper of general circulation in the Town of Mashpee, on September 24, 2004 and
October 1, 2004 a copy of which is attached hereto and made a part hereof.
A Public Hearing was scheduled on the Petition at the Mashpee Town Hall on
Wednesday, October 13, 2004 and continued numerous times for conservation issues and
finally denied the matter without prejudice at the hearing on January 12, 2005 at which
time the following members of the Zoning Board of Appeals were present and acting
throughout: James Regan, Robert Nelson, Zella Elizenberry and Richard Guerrera.
The Mashpee Zoning Board of Appeals issues this Decision pursuant to the
provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of
Mashpee Zoning By-laws.
The Board denied Mr. Grotzke's request for a Special Permit due to numerous
continuances and Mr. Grotzke not contacting the office manager to inform her of what
was going on. The Board called the petitioner at this hearing and no one showed up. The
Board felt they have given petitioner plenty of time to rectify the situation. He must
refile with the Board.
i
