• <br />Town of Mashpee <br />MASHPEE ZONING BOARD OF APPEALS 16 Great Xeck goad Jlrorth <br />DECISION FOR A VARIANCE Mashpee, Massachusetts 02649 <br />RE: Daniel and Robbin Hyde <br />8 Radcliffe Road <br />Map 22 Parcel 106 <br />V-03-20 <br />A Petition was filed on January 2, 2003 by Daniel and Robbin Hyde for a <br />Variance from Sections 174-31 and 174-21 of the Zoning By-laws for permission to vary <br />the side setbacks, relief from lot size requirements and frontage requirements in order to <br />demolish the existing deck and replace it with an addition on a pre-existing, non- <br />conforming structure on property located in an R-5 zoning district at 8 Radcliffe Road <br />(Map 22 Parcel 106) Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br />a newspaper of general circulation in the Town of Mashpee, on January 10, 2003 and <br />January 17, 2003, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, January 22, 3003 at which time the following members of the Zoning Board <br />of Appeals were present and acting throughout: James Regan, III, Robert Nelson and <br />Zella Elizenberry. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br />Mashpee Zoning By-laws. <br />❑ A Variance of 17.6 feet on the side lot line <br />❑ A Variance of 67,500 square feet for lot size requirements <br />❑ A Variance of 50 feet for the frontage requirements <br />VARIANCE CRITERIA <br />Section 10 of Chapter 40A requires that the permit granting authority determine <br />that there are circumstances relating to the shape and topography which affect this lot and <br />
