Town of Mashpee <br />16 Great Aeck &ad Jlrorth <br />MASHPEE ZONING BOARD OF APPEALSS ashpee,lJlassachusetts 02649 <br />DECISION FOR A SPECIAL PERMIT <br />Re: Daniel and Robbin Hyde <br />8 Radcliffe Road <br />Map 22 Parcel 106 <br />SP -03-19 <br />A Petition was filed on January 2, 2003 by Daniel and Robbin Hyde for a Special <br />Permit under Section 174-17 of the Zoning By-laws in order to replace and existing deck <br />with an addition on a non -conforming lot but is not more detrimental to the neighborhood <br />on property located in an R-5 zoning district at 8 Radcliffe Road (Map 22 Parcel 106) <br />Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General <br />Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br />• newspaper of general circulation in the Town of Mashpee, on January 10, 2003 and <br />January 17, 2003, a copy of which is attached hereto and made a part hereof. <br />A Public Hearing was held on the Petition at the Mashpee Town Hall on <br />Wednesday, January 22, 2003 at which time the following members of the Zoning Board <br />of Appeals were present and acting throughout: James Regan, Zella Elizenberry and <br />Robert Nelson. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br />provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br />Mashpee Zoning By-laws. <br />David Sanicki of Cape & Islands Engineering represented the Petitioner. <br />Petitioner is seeking to remove the existing deck and replace it with an addition on a non- <br />conforming lot.
