Mashpee Zoning <br />Board of Appeals Bay Point Realty Trust <br />SP -03-34 <br />3 <br />SPECIFIC FINDINGS <br />. 1. that the proposed use and development are consistent with applicable law, <br />rules and regulations. <br />2. that there will be no adverse effect on public health or safety. <br />3. that there will not be an excessive demand upon community facilities created <br />as a result of the proposal. <br />4. that there will not be a significant adverse impact on the environmental factors <br />listed in Section 174-24.C.2. <br />In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br />applicant met the criteria necessary for the granting of a Special Permit. Upon motion <br />duly made and seconded, the Zoning Board of Appeals voted unanimously on June 11, <br />2003 to grant a Special Permit conditioned on the following: <br />♦ If Mr. Benway were to sell 11 Bay Road, the property at One Point Road must be <br />sold with it. <br />♦ The garage must be no more than 15 feet in height.. <br />. ♦ Reference plans from Cape & Islands Engineering, dated June 12, 2003, revised July <br />11, 2002, revised February 3, 2003, revised February 24, 2003 and revised April 15, <br />2003, File No. 111 MA(812CC) as prepared for Eric Benway/Bay Point Realty Trust. <br />S' <br />9 <br />ati <br />
