Mashpee Zoning <br />Board of Appeals <br />2 <br />0 GENERAL FINDINGS <br />Edwin Beaudette and Leslie Gurny <br />V-03-46 <br />1. that the subject property is located at 18 Nick Trail and contains 6,500 square <br />feet. <br />SPECIFIC FINDINGS <br />The Board determined that: <br />1. a literal enforcement of the By-laws would involve hardship to the Petitioner. <br />2. the proposal would be an improvement to the subject lot and to the <br />neighborhood; therefore, relief may be granted without detriment to the public <br />good and without derogating from the intent or purpose of the By-laws. <br />3. installation of a new septic system would be an improvement to the subject <br />property; therefore, relief may be granted without detriment to the public <br />good. <br />In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br />Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br />made and seconded, the Zoning Board of Appeals voted unanimously on April 9, 2003 to <br />grant a .5 foot variance the front yard setback requirements, a 1.9 foot variance by the <br />entryway and a 3.4 foot variance in the rear setback requirements. These variances are <br />conditioned on plans from Cape & Islands Engineering, Plan No. 030303, File No. 125 <br />MA, Septic File No. 72, dated March 3, 2003. <br />
