Mashpee Board <br /> Of Appeals Mints ofApril 23,2003 <br /> 4 <br /> easier with a wheelchair. The Board moves to grant a variance of 2.8 feet on the <br /> southerly side lot line. All agree. So moved. <br /> Jared Nest: Requests a Special Permit from Section 174-25(A)(8) Zoning By- <br /> laws laws in order to build an in-lav apartment above an existing dwelling on property located <br /> in an R-5 zoning district at 15 Black Watch Way (Map 16 Parcel Mashpee, MA. <br /> Sitting: Robert Nelson, Marshall Brenn and Zella Eli enberr <br /> Mr. West represents himself at this hearing. He is seeking a special permit to build an in- <br /> law apartment that will not change the footprint of his existing dwelling. The Board of <br /> Health permits a -bedroom dwelling. He says he currently has 3 bedrooms and this will <br /> be the fourth. Mr. West mentions rental income at one point and the Board becomes <br /> uncomfortable with this. At this time, there is not any rental income allowed from an in- <br /> law apartment where a special permit is granted. Due to the gray area of the law here, it <br /> is a very fine line ofwhat is acceptable and what is not. There is a direct abutter John <br /> Casey of 25 Leamington n Lane, who is very upset about the possibility ofthis becoming <br /> legal. He feels Mr. west does not maintain his property and previously went beyond the <br /> permit granted to him with respect to being allowed to live in a trailer on his property <br /> while he was building this house. Mr. Casey feels strongly about multiple family <br /> dw.ellings being allowed in a clearly single family residential situation. After some <br /> debate, the Board denies Mr. West without prejudice.
