r . <br /> Town of Mashpee <br /> 16 Great JVeck kgad Arth <br /> X12 Mashpee, Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A VARIANCE <br /> RE: Emil R. and Alice Smith 2 Pembroke Drive <br /> Map 123 Parcel 73 <br /> V-03-103 <br /> A Petition was filed on June 19, 2003 for a Variance from Section 174-31 of the <br /> Zoning By-laws for permission to vary the setback requirements in order build an <br /> entryway, a deck and side addition on property located in an R-3 zoning district at 2 <br /> Pembroke Drive (Map 123 Parcel 73) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on June 27, 2003 and July 4, <br /> 2003, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, July 9, 2003 at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: James Regan, Robert Nelson and Zella <br /> Elizenberry <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> .David Sanicki of Cape & Islands represents the petitioners. They are seeking <br /> variance relief in order to build a new entryway and replace the existing deck and build <br /> an addition on the sideline. Mr. Sanicki goes over the plans with the Board and discuss <br /> the requested variances. Mr. Regan adds the topography of the lot in the Popponessett <br /> Overlay district is a factor in the granting of the variances. The proposed lot coverage <br /> will be 13.4%. Mr. Nelson moves to grant the following <br /> - 5 foot variance on the side <br /> • - 3 foot variance on the westerly side <br />
