Portnoy 65 Sunset Circle <br /> Map 64 Parcel 10 <br /> V-03-104 <br /> A Petition was filed on July 29, 2003 for a Variance under Section 174-33 of the <br /> Zoning By-laws to seek relief from the required distance to the wetlands in order to <br /> construct a 5'6" x 21' x 19'6" x 6' addition and 7' x 18' deck on property located in an <br /> R-5 zoning district at 65 Sunset Circle (Map 64 Parcel 10) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on August 1, 2003 and August <br /> 8, 2003 a copy of which is attached hereto and made a part hereof. <br /> • A Public Hearing was held on the Petition at Mashpee Town Hall on <br /> Wednesday, October 8, 2003, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Marshall Brem and <br /> Richard Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Sanicki of Cape & Island's Engineering represents his client at this hearing. <br /> They are seeking a 12-foot variance from the wetlands requirement setback. The <br /> Conservation Commission granted approval for this on October 2, 2003. The Board sees <br /> no problems with this. Marshall Brem moves to grant the 12-foot variance. Robert <br /> Nelson seconds the motion. <br /> GENERAL FINDINGS <br /> 1. the property is located at 65 Sunset Circle and contains 16,117 square feet. <br /> • <br />
