��Tunn(y. <br /> Town of Mashpee <br /> 16 Great JVeck Pvoad Horth <br /> �,����• Mashpee, Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Catherine Perry 114 Scituate Road <br /> Map 22 Parcel 86 <br /> V-03-132 <br /> A Petition was filed on August 20, 2003 by Catherine Perry for a Variance from <br /> Section 174-31of the Zoning By-laws for permission to vary the setback requirements in <br /> order to build a garage on property located in an R-5 zoning district at 114 Scituate Road <br /> (Map 22 Parcel 86) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on September 12, 2003 and <br /> September 19, 2003, a copy of which is attached hereto and made a part hereof. <br /> • A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, September 24, 2003, at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert Nelson, Zella Elizenberry <br /> and James Regan. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> David Webb represents his client Catherine Perry for this hearing. They are <br /> seeking a Variance in order to build a garage and the current zoning prevents them from <br /> doing so due to the setback requirements. They are looking for a 10-foot variance on the <br /> sideline. Zella Elizenberry moves to grant the variance. Robert Nelson seconds the <br /> motion. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 114 Scituate Road and contains 15,320 <br /> tsquare feet. <br />
