Mashpee, Massachusetts 02649 MASHPEE ZONING BOARD OF APPEALS Decision for a Variance RE: Edwin Thomas 55 Payamps Road Map 59 Parcel 15 V-03-136 A Petition was filed on September 16, 2003 for a Variance from Section 174-31 of the Zoning By-laws for permission to vary the lot size requirements under current zoning to deem this lot buildable. This property is located in an R-5 zoning district at 55 Payamps Road (Map 59 Parcel 15) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on September 26, 2003 and October 3, 2003 a copy of which is attached hereto and made a part hereof. • A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, October 8, 2003, at which time the following members of the Zoning Board of Appeals were present and acting throughout: Robert Nelson, Richard Guerrera and Marshall Brem. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of Mashpee Zoning By-laws. Edwin Thomas represents himself at this hearing. He is seeking land space relief in order to have this lot deemed buildable. The lot is 1.13 acres and has enough frontage. It was purchased in 1990 and the current zoning is keeping Mr. Thomas from building on this lot due to the 80,000 minimum square footage in this district. There is a 3-bedroom house being proposed to be built on this lot once Mr. Thomas is able to sell it. The Board wants to enforce the 40-foot front setback requirement from the temporary turnaround. Mr. Thomas says that is acceptable. Marshall Brem moves to grant a 49,078 square foot variance. Robert Nelson seconds the motion. •
