This property is located in an R-5 zoning district at 55 <br /> Payamps Road (Map 59 Parcel 15) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on September 26, 2003 and <br /> October 3, 2003 a copy of which is attached hereto and made a part hereof. <br /> • A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, October 8, 2003, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Robert Nelson, Richard Guerrera and <br /> Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Edwin Thomas represents himself at this hearing. He is seeking land space relief <br /> in order to have this lot deemed buildable. The lot is 1.13 acres and has enough frontage. <br /> It was purchased in 1990 and the current zoning is keeping Mr. Thomas from building on <br /> this lot due to the 80,000 minimum square footage in this district. There is a 3-bedroom <br /> house being proposed to be built on this lot once Mr. Thomas is able to sell it. The Board <br /> wants to enforce the 40-foot front setback requirement from the temporary turnaround. <br /> Mr. Thomas says that is acceptable. Marshall Brem moves to grant a 49,078 square foot <br /> variance. Robert Nelson seconds the motion. <br /> • <br />
