Town of Nashpee <br /> 5/r' �trs <br /> 3 \� <br /> 16 Great Xeck Poad Sorth <br /> Nva <br /> Mashpee, Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Warren Benson 130 Summersea Road <br /> Map 105 Parcel 55 <br /> V-03-144 <br /> A Petition was filed on October 17, 2003 by Warren Benson for a Variance from <br /> Sections 174-33 of the Zoning By-laws for permission to vary the front and sideyard <br /> setback requirements, frontage requirements and land space requirements to allow for <br /> construction of a single-family home on property located in an R-3 zoning district at 130 <br /> Summersea Road (Map 105 Parcel 55) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> • newspaper of general circulation in the Town of Mashpee, on October 24, 2003 and <br /> October 31, 2003, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday,November 12, 2003 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James E. Regan III, Robert G. <br /> Nelson and Richard Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinsky of Cape & Islands Engineering represents the Petitioner. They are <br /> seeking to demolish and rebuild a new structure and need several variances to complete <br /> their proposed plans. Their lot size is problematic due to the change in the zoning <br /> requirements to that district. The Conservation Commission is limiting their house to 2 <br /> bedrooms although their new septic systems can accommodate a 3-bedroom house. The <br /> Board feels this would be an improvement to the area. Mr. Nelson moves to grant the <br /> • requested variances. Mr. Guerrera seconds the motion. <br />
