f <br /> Town of Nashpee <br /> s <br /> 16 Great Seek Pvoad Xorth <br /> Mashpee, Massachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Special Permit <br /> RE: Warren Benson 130 Summersea Road <br /> Map 105 Parcel 55 <br /> SP-03-143 <br /> A Petition was filed on October 17, 2003 by Warren Benson to request a Special <br /> Permit under Section 174-20 of the Zoning By-laws to allow for demolition of an <br /> existing house in order to construct a new house on property located in an R-3 zoning <br /> district at 130 Summersea Road (Map 105 Parcel 55) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, on October 24, 2003 and <br /> • October 31, 2003 a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday,November 12, 2003 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: Robert G. Nelson, James Regan <br /> and Richard Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Law, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> John Slavinsky of Cape & Islands Engineering represented the petitioners at this <br /> hearing. They are seeking a Special Permit in order to demolish an existing structure and <br /> rebuild a new house. The existing septic system is only a couple of years old however <br /> conservation will only allow a 2 bedroom house although the septic system will <br /> accommodate three bedrooms. Mr.Nelson moves to grant the Special Permit. Richard <br /> Guerrera seconds the motion. <br /> • <br />
