' f i <br /> 4�i mrnti4� <br /> -�..._•yu� Town of Mashpee <br /> N�4 y 16 Great Xeck Pvoad Aorth <br /> �,���• Mashpee, ATassachusetts 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Decision for a Variance <br /> RE: Robert Curtis 32 Hook Drive <br /> Map 122 Parcel 278 <br /> V-03-155 <br /> A Petition was filed on October 30, 2003 for a Variance from Section 174-31 of <br /> the Zoning By-laws to vary the current setback requirements in order to install a <br /> swimming pool on property located in an R-3 zoning district at 32 Hook Drive (Map 122 <br /> Block 278) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation on November 28, 2003 and December 5, 2003 a copy <br /> of which is attached hereto and made a part in the Town of Mashpee, on hereof. <br /> • A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, <br /> December 10, 2003 at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, James Regan and Frederick <br /> Borgeson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. Tom Jallowy represents the petitioner at this hearing. He is seeking a variance to <br /> install a pool on the property. He discusses the layout of the pool with reference to the <br /> property lines. The Board feels this is reasonable. The Board moves to grant a 7-foot <br /> variance in the rear and a 5-foot variance on the sideyard. No comments from abutters. <br /> GENERAL FINDINGS <br /> 1. that the subject property is located at 32 Hook Drive and contains 16,940 <br /> • square feet. <br />
