Fox 42 Tritown Circle <br /> Map 40 Parcel 29 <br /> V-03-148 <br /> A Petition was filed on November 25, 2003 for a Variance from Section 174-31 <br /> of the Zoning By-laws to vary the current setback requirements in order to build an <br /> accessory structure on property located in an R-5 zoning district at 42 Tritown Circle <br /> (Map 40 Block 29) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation on November 28, 2003 and December 5, 2003 a copy <br /> • of which is attached hereto and made a part in the Town of Mashpee, on hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, <br /> December 10, 2003 at which time the following members of the Zoning Board of <br /> Appeals were present and acting throughout: Robert Nelson, James Regan and Marshall <br /> Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Robert Fox represents himself at this hearing. He is seeking a variance from the <br /> setback requirements in order to build an accessory structure . He shows the Board his <br /> drawings for the apartment and has discussed this with Russ Wheeler, Building Inspector. <br /> He proposes a deck that will connect both the existing dwelling and the new dwelling. . <br /> Mr. Regan feels that this could be granted with conditions that the apartment become <br /> attached to the main dwelling with a new set of plans that petitioner is willing to provide. <br /> Since time is of the essence to the petitioner, the decision will be based upon new plans <br /> • <br />
