Fox 42 Tritown Circle <br /> Map 40 Parcel 29 <br /> SP-03-147 <br /> A Petition was filed on November 25, 2003 by Robert Fox for a Special Permit <br /> under Section 174-25.A.8 of the Zoning By-laws to build an accessory structure to the <br /> existing dwelling on property located in an R-5 zoning district at 42 Tritown Circle (Map <br /> 40 Parcel 29) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a <br /> newspaper of general circulation in the Town of Mashpee, November 28, 2003, and <br /> December 5, 2003 a copy of which is attached hereto and made a part hereof. <br /> • A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, December 10, 2003 at which time the following members of the Zoning <br /> Board of Appeals were present and acting throughout: James Regan, Robert Nelson and <br /> Marshall Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws, Chapter 40A, Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Robert Fox represents himself at this hearing. He is seeking a special permit to <br /> build an accessory structure and a variance from the setback relief. He shows the Board <br /> his drawings for the apartment and has discussed this with Russ Wheeler, Building <br /> Inspector. He proposes a deck that will connect both the existing dwelling and the new <br /> dwelling. The Board would like to see a more substantial structure connecting both <br /> dwellings and will condition this permit upon plans submitted to the building department <br /> showing such a structure. The Board moves to grant the Special Permit. <br /> • <br />
