Town of Mashpee <br /> a`J �1 SIy <br /> 3 <br /> v y 16 Great Seek Pvoad JVorth <br /> MASHPEE ZONING BOARD OF APPEALS`x1ashpee, Massachusetts 02649 <br /> Decision for a Special Permit <br /> RE: Paul O'Connell III, Trustee 99 Monomoscoy Road West <br /> Of Monomoscoy West Realty Trust Map 120 Parcel 45 and 46 <br /> SP-03-154 <br /> A Petition was filed on October 29, 2003 for a Special Permit under Section 174- <br /> 25.I.9 of the Zoning By-laws in order to build a pier, ramp and float on property located <br /> in an R-3 zoning district at 99 Monomoscoy Road West (Map 120 Parcel 45 and 46) <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on November 28, 2003 and <br /> December 5, 2003 a copy of which is attached hereto and made a part hereof. <br /> • A Public Hearing was heard on July 28, 2004 on the Petition at the Mashpee <br /> Town Hall at which time the following members of the Zoning Board of Appeals were <br /> present and acting throughout: James Regan, Robert Nelson, Marshall Brem and Richard <br /> Guerrera. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Attorney Robert Mills and John Slavinksy of Cape & Islands Engineering <br /> represent the applicant at this hearing. This matter has been approved by Conservation <br /> and all previous issues have been cleared up. The dock will be 68 feet from MHW and <br /> does not need a variance. Mr. Mills and the Board review the plans. The lot is presently <br /> vacant and this special permit will be subject to substantial commencement of <br /> construction of a new dwelling on said property. Marshall Brem moves to grant the <br /> special permit. <br /> • <br />
