Town of Mashpee w�il�'•4hti{,�yFi L. 16 Great Xeck Aoad Xorth o MASHPEE ZONING BOARD OF APPEALWashpee, Massachusetts 02649 Decision for a Variance RE: Peter A. & Gretchen Maglione, Trustees 30 Ockway Bay Road V-02-12 Map 100 Parcel 54 A Petition was filed on December 3, 2001 by Peter A. and Gretchen Maglione, Trustees, of Mashpee, Massachusetts for a Variance from Section 174-25.I.9 of the Zoning By-laws to exceed the 70-foot total length limit to allow for construction of a pier, ramp and float on Ockway Bay on property located in an R-3 zoning district at 30 Ockway Bay Road (Map 100 Parcel 54) Mashpee, MA. Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in the Town of Mashpee, on December 21 and December 28, 2001, a copy of which is attached hereto and made a part hereof. A Public Hearing was held on the Petition at the Mashpee Town Hall on Wednesday, January 9 2002 at which time the following members of the ZoningBoard �3' g i i of Appeals were present and acting throughout: Zella E. Elizenberry, Frederick R. Borgeson and Marshall A. Brem. The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of Mashpee Zoning By-laws. Mr. David Sanicki of Cape & Islands Engineering represented the Petition and stated that plans call for construction of the pier, ramp and float on the subject property. Mr. Sanicki said that the Conservation Commission is requiring construction of a long ramp through the woods rather than through the marsh. Mr. and Mrs. Maglione also attended the meeting. The Shellfish Constable and the Conservation Commission have approved the proj ect. No comments were received from abutters.
