Town of Mashpee <br /> w�il�'•4hti{,�yFi <br /> L. <br /> 16 Great Xeck Aoad Xorth <br /> o MASHPEE ZONING BOARD OF APPEALWashpee, Massachusetts 02649 <br /> Decision for a Variance <br /> RE: Peter A. & Gretchen Maglione, Trustees 30 Ockway Bay Road <br /> V-02-12 Map 100 Parcel 54 <br /> A Petition was filed on December 3, 2001 by Peter A. and Gretchen Maglione, <br /> Trustees, of Mashpee, Massachusetts for a Variance from Section 174-25.I.9 of the <br /> Zoning By-laws to exceed the 70-foot total length limit to allow for construction of a <br /> pier, ramp and float on Ockway Bay on property located in an R-3 zoning district at 30 <br /> Ockway Bay Road (Map 100 Parcel 54) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Mashpee Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee, on December 21 and <br /> December 28, 2001, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 9 2002 at which time the following members of the ZoningBoard <br /> �3' g <br /> i <br /> i <br /> of Appeals were present and acting throughout: Zella E. Elizenberry, Frederick R. <br /> Borgeson and Marshall A. Brem. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petition and <br /> stated that plans call for construction of the pier, ramp and float on the subject property. <br /> Mr. Sanicki said that the Conservation Commission is requiring construction of a long <br /> ramp through the woods rather than through the marsh. Mr. and Mrs. Maglione also <br /> attended the meeting. <br /> The Shellfish Constable and the Conservation Commission have approved the <br /> proj ect. <br /> No comments were received from abutters. <br />
