i <br /> Mashpee Zoning Willowbend Development Corporation 5 <br /> Board of Appeals Golf Course Expansion <br /> V-02-16 <br /> 2. the shape of the subject property and the impact of wetlands on the <br /> } topography of the subject property limit placement of the proposed golf <br /> course expansion and rest station; therefore, a literal enforcement of the <br /> By-laws would involve hardship to the Petitioner. <br /> 3. construction of the proposed golf course expansion and installation of the <br /> proposed water conservation techniques would eliminate the development of <br /> 77 new homes and would be an improvement to the subject property; <br /> therefore, relief may be granted without substantial detriment to the public <br /> good. <br /> 4. the Cape Cod Commission has approved the proposal with conditions and <br /> restrictions that address sensitive environmental and public issues. <br /> 5. the proposed installation of plantings and landscaping would mitigate the <br /> encroachment on the setback requirements; therefore, relief may be granted <br /> without derogation from the intent or purpose of the By-laws. <br /> 6. donation by the Petitioner of 20 acres of land would be a substantial benefit to <br /> the Town. <br /> In view of the foregoing, the Mashpee Zoning Board of Appeals found that the <br /> Petitioner met the criteria necessary for the granting of a Variance. Upon motion duly <br /> made and seconded, the Zoning Board of Appeals voted unanimously on February 27, <br /> 2002 to grant the following: <br /> Southern area: <br /> 1. Golf hole number 22: golf tee northeast of the Project abutting Quinaquisset <br /> Avenue—a Variance of 40 feet. <br /> 2. Golf hole numbers 19 20 21: an area east of the Project and south of <br /> Quinaquisset Avenue—a Variance of 25 feet. <br /> 3. Golf hole numbers 22 & 23: an area along the eastern border of the Project <br /> specifically, the southern and eastern side of proposed golf hole number 22 <br /> and the northwest side of proposed golf hole number 23 —a Variance of 50 <br /> feet. <br /> 4. Golf hole numbers 22 & 23: setback for construction of rest station located <br /> between the proposed golf green number 22 and tee number 23, adjacent to <br /> lake number 22—a Variance of 110 feet. <br /> Northern area: <br /> 1. An area along Sampson's Mill Road between Simon's Road and Mashpee <br /> Neck Road—a Variance of 40 feet. <br /> The Variance is conditioned upon compliance with: <br /> 1. VHB Vanasse Hangen Brustlin, Inc. plan entitled"Zoning Compliance Plan <br /> for Willowbend Golf Modification, Mashpee, Massachusetts, Date: 2/4/02, <br /> General Revisions: 2/19/02, 2/25/02, Project Number: 06528". <br /> 2. Willowbend Golf& Land Design plans entitled "Willowbend 9 Hole Golf <br /> Expansion, Golf Course Architectural Plans, Date: 17-Jan-2002". <br /> i- " <br />
