Hanlon SP-02-18 51 Popponesset Island Road <br /> Map 106 Parcel 13 <br /> I, <br /> A Petition was filed on December 7, 2002 by Paul L. and Kristen C. Hanlon <br /> of Walpole, Massachusetts for a Special Permit under Section 174-20 of the Zoning <br /> By-laws to allow for demolition of an existing structure and construction of a <br /> single-family home on property located in an R-3 zoning district at 51 Popponesset <br /> Island Road (Map 106 Parcel 13) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General 'I <br /> Laws Chapter 40A. Notice was given by publication in The Cape Cod Times, <br /> a newspaper of general circulation in the Town of Mashpee, on January 7 and January 14, <br /> 2002, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 23, 2002, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, Robert G. Nelson III' <br /> and Frederick R. Borgeson. Mr. Regan stepped down and left the room. <br /> SII <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town of <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petition and <br /> stated that plans call for demolition of the existing structure on the subject property. He <br /> said that the proposed new construction would exceed the allowed 20% lot coverage by a <br /> minimal .4% and would encroach on the setback requirements to water and wetlands by 9 <br /> feet. j <br /> The Conservation Commission has approved the project and issued an Order of <br /> Conditions. <br /> No comments were received from abutters. <br /> I, <br /> SPECIAL PERMIT CRITERIA <br /> § 174-20 of the Zoning By-laws states: <br /> "Rebuilding of destroyed or damaged nonconforming structure. <br /> Any nonconforming building or structure destroyed or damaged by fire, flood lightning, <br /> wind or otherwise may be rebuilt, subject to approval of the Board of Appeals subject to <br /> the same conditions as set forth in § 174-24 of this chapter". <br /> i <br /> I <br />
