Owner <br /> P ) of record: <br /> P Gerald P. Labute. <br /> Notice was duly given to abutters in accordance with Massachusetts General <br /> Laws Chapter 40A. Notice was given by publication in The Cape Cod Times, a <br /> newspaper of general circulation in the Town of Mashpee, on January 7 and January 14, <br /> 2002, a copy of which is attached hereto and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday,nesday, January 23, 2002, at which time the following members of the Zoning Board ' <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Robert G. Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 9 and the Town <br /> of � !' <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape & Island <br /> s Engineering represented <br /> the Pe <br /> titio <br /> ner, <br /> Mr. <br /> Casey, who also attended the meeting. Mr. Sanicki said that the subject properties <br /> lie <br /> within a C-2 zoning district. Mr. Casey indicated that his business hours would normally <br /> ki <br /> run from 7 A.M. to 3:30 P.M. or 5 P.M., Monday through Friday, with some activity on <br /> Saturdays during ng the busy seasons. Messrs. Sanicki and Casey stated that plans call for <br /> installation of extensive landscaping <br /> on the subject properties. <br /> The Petitioner has received approval from the Design Review and Technical <br /> Review Committees. <br /> Mr. Edmund J. Belekewicz, an abutter, expressed concern with the location of the <br /> proposed driveway. The Board made certain that Mr. Casey satisfactorily addressed all of <br /> Mr. Belekewicz's concerns. <br /> The Board discussed the specifics of the Special Permit request and asked if the <br /> Petitioner would offer retail sale of merchandise inside the proposed building and store <br />
