Daley, <br /> Trustees, of Sharon, Massachusetts for a Variance from Sections 174-25.L9 and 174-31 <br /> of the Zoning By-laws to vary the side setback requirements and to exceed the allowed <br /> 70-foot total length limit to allow for construction of a pier, ramp and float on Ockway <br /> � I <br /> Bay on properties located in an R-3 zoning district at 10 and 12 Little Neck Lane <br /> (Map 105 Parcel 3 and Map 105 Parcel 4) Mashpee, MA. <br /> Ii I <br /> Notice was duly given to abutters in <br /> accordance with Massachusetts s <br /> General � <br /> Laws Chapter 40A. Notice was given by publication in The Cape Cod Times, <br /> a newspaper of general circulation in the Town of Mashpee, on January 7 and January 14, <br /> 2002, a copy of which is attached hereto and made apart hereof. <br /> f. I <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall on <br /> Wednesday, January 23, 2002, at which time the following members of the Zoning Board <br /> of Appeals were present and acting throughout: Edward M. Govoni, James E. Regan III <br /> and Robert G. Nelson. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the <br /> provisions of Massachusetts General Laws Chapter 40A Section 10 and the Town of jl j II f <br /> Mashpee Zoning By-laws. <br /> Mr. David Sanicki of Cape & Islands Engineering represented the Petition and <br /> stated that a portion of the existing pier, ramp and float is built on a neighbor's property. <br /> Plans call for the existing decking to be relocated onto the owner's property. The ramp <br /> and float would remain in the same place. The Petitioner is seeking a Variance to exceed <br /> the total length limit to allow for the proposal. The Building Commissioner confirmed <br /> that the subject property is in the Special Permit area. <br /> The Conservation Commission and the Shellfish Constable have approved the <br /> project. <br /> No comments were received from abutters. <br />
